Terms of Acceptable Use Agreement

These terms represent the complete agreement and understanding between LaserNeedle Web Solutions Inc. (herein referred to as LaserNeedle.com) and the account holder (herein referred to as the customer) and supercedes all other written or oral agreements.  LaserNeedle.com reserves the right to modify these terms and conditions, discontinue or change services offered, and alter price structures as necessary. LaserNeedle.com agrees to notify the customer of said changes in the form of a single e-mail sent to the primary address listed on the customer's account.

If at any time you do not agree with these stated terms of acceptable use please notify LaserNeedle.com and your account will discontinue your services immediately.

1. LaserNeedle.com makes no warranties of any kind whether expressed or implied for the services it provides. LaserNeedle.com makes no claims of fitness of its services for any particular use. LaserNeedle.com is not responsible for any damages the customer may suffer including but not limited to damages resulting from service interruptions, loss of data, non-deliveries or misdeliveries of e-mail due to customer error or third party intervention.

2. The customer shall hold harmless and defend LaserNeedle.com from any liability, damage, loss, claim or expense arising from the customer's breech of any part of this agreement.

3. All services provided to the customer by LaserNeedle.com may be used for lawful purposes only. All information, data, or material whether transmitted, published or stored that is in violation of any U.S. Federal or state laws or regulations is strictly prohibited and will be removed from LaserNeedle.com servers upon discovery.  This includes but is not limited to material that is protected by copyright,  trade secret or any other statute.

4. LaserNeedle accounts may not be transferred to any third party and the services of said accounts may not be resold or leased to any third party. The customer may assign e-mail addresses (other than the primary e-mail address on the customer's account) to a person or persons under direct supervision of the customer or the customer's responsible party and/or department for said services.

5. If LaserNeedle.com determines in its sole discretion that the material contained in the customer's website or transmitted via any LaserNeedle.com service whatsoever is in anyway detrimental or damaging in any way to LaserNeedle.com or to any third party it reserves the right to cancel service at any time without prior notice. In the case of cancellation of service, any unused portion of fees will be returned to the customer on a prorated basis except where the cancellation of services is the result of a direct violation of this agreement. Violation of this agreement may include but is not limited to the posting of pornographic, warez, or graphically violent content.  

6. The customer agrees to limit the use of LaserNeedle.com service, equipment, or e-mail addresses to transmit same or substantially similar messages to more than 50 recipients.  Violation of this policy will result in the suspension and possible termination of LaserNeedle.com services to the customer.

7. The customer agrees not to use any LaserNeedle.com service or equipment for the purpose of spamming or sending any unsolicited transmissions of any kind. This may include but is not limited to the transmission of any advertisements, materials or publications that are unsubscribed to or unsolicited by the recipient.

8. LaserNeedle.com requires that any agreement or contract entered into is done so by a person who is legally qualified. Customer(s) must be at least eighteen (18) years of age.  Payments cannot and will not be accepted by persons who are not at least eighteen (18) years of age.

9. The customer shall not in any way disrupt or discontinue any LaserNeedle.com service, equipment , network or part of network through the implementation of any development or use of said services.  Such disruption or discontinuance will result in the subsequent restriction of processor and/or bandwidth usage. 

10. The customer will not employ the use of or store any program, or script designed to in any way harm any other computer or network.  Nor will the customer employ or store any such program or script designed to make changes or alterations to programming, program settings or data stored on any computer without the expressed consent of that computer's owner.

11. The customer warrants that any materials published on LaserNeedle.com servers do not in any way violate or infringe on any copyright, patent, trademark, statutory common law, proprietary interest of any party or contain any material considered to be obscene or libelous.

12. LaserNeedle.com reserves the right to post both public and private listings of the customer's default url(s).

13. LaserNeedle.com may be contacted via e-mail at uhoh@laserneedle.com by any party seeking to report any potential violation of this agreement.

14. LaserNeedle.com may need to communicate with the customer through e-mail regarding billing or changes in service.  It is the responsibility of the customer to check for e-mail sent to the primary e-mail address listed on the account.

15. It is the customers responsibility to notify LaserNeedle.com of any changes to their account such as credit card information, address, phone, etc. LaserNeedle.com will for security purposes require customers to provide verification of identity before being allowed to make changes to said account.

16. LaserNeedle.com expressly prohibits the customer from disseminating services, goods or offers of a fraudulent nature.  LaserNeedle.com also prohibits the furnishing of false information or data such as identity, contact information, credit card numbers, etc. on any online application, registration, form or contract.
